What should I do if I am arrested?

Remember: YOU HAVE THE RIGHT TO REMAIN SILENT! While police officers provide a valuable service to our community, they are not your “friends” when they are questioning, interrogating, investigating, or arresting you. All you are required to do is obey lawful commands, such as “Step out of the vehicle”, and identify yourself. While keeping in mind that you should always be courteous to police officers, you must always remember that you do not have to answer any other questions when you are being detained. Also, you may be “detained or “arrested” even though you don’t have any handcuffs on your wrists. When an officer is detaining you, ask yourself: “Would a reasonable person in your position feel that they are not free to leave?” That means, if an officer asks you to stop and then questions you, ask the officer: “Am I under arrest?” If the officer says, “NO,” then ask, “Am I free to leave?” If the officer says “no”, you are technically arrested and the officer will have to justify at that exact moment if he had probable cause to believe you had committed, are presently committing, or about to commit a crime. At that moment, ask to speak to your attorney.
