What do I have to expect if I’m arrested or given a notice to appear in court?

Once in court, you have the right to plead guilty or not guilty. If you plead not guilty, you are entitled to a jury trial (in front of a jury) and a bench trial (in front of a judge). You should never go into court without the proper legal representation. You wouldn’t go into surgery to operate on yourself without a surgeon, would you? If you plead not guilty, you will want an attorney to handle the case for you, review the evidence for any legal technicalities, challenge the police action against you, advise you as to all your legal rights while informing you of any collateral consequences of being found guilty of the charges and represent your interests to the court and State. There is a lot more to lose than money and time. You could be sentenced to work release or imprisonment in jail or actual prison, ordered to perform public service hours, and even pay thousands of dollars in restitution for any damage done by your alleged actions. Hall & Rustom L.L.C. have represented clients in many jury trials, bench trials, hearings, and court appearances. If you plead not guilty and request a trial, you will want our attorneys to work for you.

If you chose to plead guilty, you may think that you can negotiate with the State yourself. That would NOT be a wise decision. The prosecutors have no duty to inform you of any collateral consequences, such as your driver’s license being suspended as a result to your pleading guilty to a criminal misdemeanor. Without an attorney, you may think you are receiving a good deal from the State when, in reality, it is a bad deal thus changing your life drastically. Hall & Rustom L.L.C. has extensive negotiating experience and can work with the prosecutors to get you the best deal legally possible, while assessing the “big picture” to ensure you make an informed decision.
