What is the difference between an informal hearing and a formal hearing?

An informal hearing usually takes place at your local DMV in front of the local informal hearing officer. The hearing officer will then make a recommendation to the Secretary of State and any driving permits or driving relief will be approved by the Secretary of State.

A formal hearing takes place in one of four places: Springfield, Mt. Vernon, Chicago, and Joliet. At the hearing, testimony is presented under oath and the formal hearing officer listens to evidence presented by the Attorney General’s office and by you, the petitioner. After the hearing, and generally within 90 days, the Hearing Officer makes a recommendation to approve or deny driving relief. If we meet our burden of proof showing that you, the petitioner, are no longer a danger to Illinois driver’s, then reinstatement is likely.
