I was pulled over for speeding and I'm already on court supervision. Am I going to lose my license?

WHAT YOU SHOULD DO:

  • Wait to speak to an attorney here at Hall & Rustom L.L.C. before you pay the ticket.

  • Pay the ticket through the mail or at the courthouse without consulting an attorney.
  • Go to court and negotiate the ticket by yourself.

In Illinois, if you are over 21 years of age, you can receive two moving violation convictions on your record before your driver’s license is suspended. If you receive a third conviction, the Secretary of State will suspend your driver’s license for a period of no less than 3 months. Depending on the severity of the moving violation (Speeding 10mph over the limit vs 30 mph over the limit), your suspension will vary between 3 months and 12 months.

If you receive court supervision and then receive another traffic citation during your court supervision, you will want to contact an attorney immediately. If the prosecution discovers the new violation, they can petition the court to revoke your court supervision. You are entitled to a hearing; however, if your court supervision is revoked, a conviction will likely enter and points will be assigned to your license. With that conviction on your record, the new citation you received will likely be a conviction as well when negotiated or worked out in court. That will result in two convictions on your record. If you had a previous conviction within 1 year from the citation you received court supervision (that was revoked), you will likely be suspended because the third ticket is your third conviction.

Even petty traffic violations have serious ramifications. Also, you will have to go to traffic court if you would like to request court supervision. Depending on the size of the county, you could wait hours in line to resolve your ticket.
